CERINȚE
– avocat definitiv cu experiență în profesie de minim 6 ani;
– cunoștințe în materia dreptului insolvenței, a dreptului civil și a dreptului procesual civil;
– experiență solidă în redactarea de acțiuni, întâmpinări, contracte, opinii legale, notificări, somații și participarea la negocieri;
– abilități de comunicare și de negociere, spirit de echipă, flexibilitate, eficiență și responsabilitate;
– inițiativă în modul de gestionare a dosarelor încredințate;
– practică dreptul din pasiune, dornică să se perfecționeze continuu;
– a avut rezultate bune la examenele teoretice de-a lungul parcursului universitar;
– calitatea de practician în insolvență constituie un avantaj.

RESPONSABILITĂŢI
– studierea temeinică a dosarelor încredințate;
– documentarea juridică în vederea formulării acțiunilor/pozițiilor procesuale în fața instanțelor de judecată;
– redactare acțiuni, întâmpinări, diverse cereri și poziții procesuale;
– redactare rapoarte de activitate și acte de procedură în dosare de insolvență.

RESPONSIBILITIES

KEY RESPONSIBILITIES

Legal Strategy: Drive legal strategy discussions, offering unparalleled insights into EU financial regulations. Your expertise will be integral in shaping the legal landscape for our clients and positioning them for success.
Global Collaboration: Collaborate with SBCR’s global network of legal minds, ensuring a seamless approach to client service. Your ability to work across borders will enhance our client offerings and reinforce our standing as an international legal powerhouse.
Licence Acquisition: Support clients in obtaining licenses, guiding them through the regulatory landscape. Liaise with multiple EU regulators of financial markets to facilitate the registration and authorization process.

THE ACTIONS YOU WILL TAKE
– gain an understanding of the business and technical requirements for the envisioned product proposition in conjunction with SBCR and client teams;
– identify and mitigate significant regulatory risks in a practical and scalable manner; forecast and identify critical regulatory risks;
– identify prospects for enhancing both new and established products while also questioning market practises and interpretations;
– deliver succinct and pragmatic regulatory counsel pertaining to banking and financial services regulations, in accordance with SBCR’s commercial and strategic goals that permit forescaling;
– in order to scope regulatory requirements and validate solutions, collaborate with external counsel.

WHO YOU ARE
– you possess prior experience working either internally or for a reputable law firm, where you provided regulatory advice pertaining to EU/RO financial regulatory laws;
– you possess the capability to comprehend intricate product and regulatory obstacles and transform them into methodical, applicable, and implementable resolutions;
– you possess effective communication abilities and can effectively convey the designed solutions to stakeholders, both internal and external in nature;
– you are cognizant of pertinent risks, capable of assessing their repercussions, and capable of incorporating them into product team decision-making processes;
– your strong initiative and self-motivation will be an asset in an environment that is rapidly evolving and technology-driven;
– you possess excellent written and oral communication skills in English (C1/C2 level), Romanian (C1/C2 or native level), and preferably in French/ German/ Dutch/ Arabic (minimum B1+ – B2 level).
Optional: Experience with contract, tort and property law.
Desirable: Strong mediation, arbitration and litigation abilities.

QUALIFICATIONS
Elite Legal Background: Hail from an esteemed legal background, with a stellar academic record and admission to the bar in the Netherlands and as „avocat definitiv” or „consilier juridic definitiv” in the Bucharest Bar. You hold an LLM from either the United Kingdom or an EU Member State.
Global Regulatory Expertise:** Showcase a minimum of 2 – 6 years of experience as a luminary in EU financial regulations, with a focus on MiCA, MiFID II, MiFIR, MAR, AMLD5, TFR, AIFMD, and Crowdfunding.
Proven Rainmaker: Demonstrate a track record of rainmaking in the legal arena, with a portfolio of high-profile clients in the financial sector (desirable for profit share).

Salary: RON 78,000 – 108,000 per annum

Legal Research and Practice Expansion Financed by SBCR are options on the table. The envisaged practices are legal services dealing with the AI Act, VAT across the EU (e.g., Union OSS, Reverse-Charged, B2B, Commodities), Real Estate,
FinTech, Banking, Gambling Licenses, Insurance, Medical regulations, Cybersecurity, International Tax Structures, Corporate law, Inheritance, and Asset protection (e.g., trusts).
